Description of the Service

The Service is intended primarily for use by professional athletes (“Users”, in singular “User”), and it makes it possible for the athlete Users to
‍
- have a single place of storage of their medical data relevant for analyzing and development of their athletic exercises and professional career;
- authorize their doctors and other medical service professionals to access, store and browse their medical data and other information (hereinafter “Material”) stored in the Service;
- retain control of their medical data in all circumstances.

The Service is provided as a cloud service available at heely.io. The service description applicable at the given time is available at heely.io.

The Material in the Service is not transferred to any other medical databases and may not be accessed by any medical institutions or persons other than those for whom the User has explicitly provided access rights through the Service.

In some jurisdictions the delivery of the Service may be subject to some formal approval, permit or other regulatory requirements. Heely warrants and undertakes at all times to comply with all mandatory legal requirements relating to the provision of the Service by Heely in those countries where the Service is actively promoted.

The Service is provided free of charge for the Users identified as athletes. Heely may charge a subscription fee from sports club or doctors or for other professional use of the Service and access to the Material.

Security of the Service

Heely maintains appropriate security processes and measures to protect security of the Service and the Material.

The User must keep the usernames and passwords for the Service safe and confidential. Username and password are intended only for the User and must not be shared with anyone. The user should notify Heely without delay if username or password has been used or accessed by unauthorized persons. The user accounts are user specific and may not be shared with others.

User and only user controls the access rights to the Material in the Service. The user must carefully verify the identities and credentials of third parties (like doctors) to whom the user provides access rights in the Service. The identities of third parties are not verified by the Service.

Changes to Service

Heely has the right at any point, for any reason and without prior notice to change the Service, including its appearance or usability level or other aspects related to the Service features, or to close the Service partly or entirely. In addition, Heely has the right to suspend the operation of the Service for the duration of maintenance and update measures without prior notice.

Ownership of Service and Material

Heely or its licensors own and retain all right and title to the Service and any modifications made thereto. If the user provides any feedback or suggestions relating to the content, functionalities or development of the Service, Heely shall have the right to use such freely in further development of the Service.

The trademarks and logos on the Service may not be published, copied or distributed without Heely’s written consent.

User retains all rights in the Material inserted by or for the user in the Service. Heely may not use or access the Material, except where necessary for the delivery of the Service.

User may request his/her Material in a legible format from the Service at any time through the functionalities provided in the Service.

Cookies

The use of the Service requires the User to enable cookies or similar documents through computer and browser settings. Heely only uses cookies or similar documents that are technically necessary for the Service to work correctly. The cookies or similar documents do not transmit the User’s personal data.

Heely’s Liability

Heely shall make reasonable effort to keep the Service up and running on 24/7/365 basis substantially in accordance with the then-current service description. In addition, Heely shall make reasonable effort to correct any errors and malfunctions as soon as reasonably possible. However, Heely does not promise that the Service will work without interruptions or faults and Heely is not liable for any damage caused to the User by the use or prevented use of the Service or caused by defects, interruption or loss of data in the Service.

Heely’s sole liability and the User’s sole remedy for breach of these terms of use shall be for Heely to rectify, without undue delay, the breach, or where such rectification is not reasonably possible or feasible, to terminate the User’s access to the Service and return all Material of the User in a legible format. Heely’s total aggregate liability under these terms of use shall be limited in all circumstances to 100 euros.

Third Party Material

Heely is in no way responsible for the content or operation of other services available through its Service or external data or other material accessed by or used in the Service (e.g. third party reference material or analysis). When moving to a linked website, the User understands that the website in question is not controlled by Heely and Heely has no control over its content.

Data Protection

The Service is designed to improve Users right to informational self-determination with respect to the Material. This means that the Users’ rights regarding their personal data, as granted under applicable data protection legislation, are at the center of the Service provided by Heely. For more information on the purposes for which Heely processes personal data, recipients of personal data as well as the rights available to the User, please refer to Heely’s privacy policy available here.

It should be noted, however, that the third parties authorized by the User to access the Material as well as the User’s sports club or similar organization are responsible for ensuring that their respective use of the Service complies with applicable data protection legislation. Heely is not responsible for the actions or inactions of such parties.

Applicable Law

These terms of use are governed by Finnish law. Any disputes relating to the Service will be resolved in the Helsinki District Court.

Miscellaneous

Heely has the right to change these terms of use at any time by informing the users of the change. Such notice will be available at the Service. If the user continues the use of the Service after the change of terms has been notified, the user shall be deemed to have accepted the new terms.
